Worker’s Compensation: The Effects of Negligence…Dr. Lenselink, Bloomington, MN

Worker’s Compensation also known as Work Comp (WC) is a term everyone who works should know. Worker’s Compensation is when an employee is injured at work do to negligence at their workplace and their employer offers that person benefits. The benefits include but are not limited to wage-loss, medical and rehabilitation benefits. Here at AdvaCare Clinics we know all the ins and outs of work comp.

The first step in filing a WC clam is to immediately contact your employer after the incident occurs. The employer is then required to complete a First Report of Injury (FROI) form.

After the report is completed depending on the type of accident the employee can choose to go to any clinic of his or her choosing for care. Once a clinic has been chosen that provider must be informed of the injury being caused at work, for if the clinic tries to bill the claim out to the patient’s primary health insurance the health insurance can reject the claim if they obtain information on the injury being caused at the patients place of work.

Once the clinic has established the patient as a WC case they will require certain documents to be completed, and of those documents the most important one is the Work Ability Form. This form shows any limitations that the patient may have obtained after the incident. These restrictions or limitations may be, weight restrictions, length of time spent working, how many breaks the effected employee is allotted per work shift, and many more.  This work ability form is given to the patient every two weeks, or when the restrictions change to give to their employer, or the clinic may send the document via fax or email to whomever is handling the patient’s case.

The time span of a Work Comp case averages out to be 12 weeks. Throughout this period the patient should be making improvements to decrease their work limitations. The care experienced at their chosen clinic should be aiding the patient in reaching this goal. Once the patient has completed their treatment plan, and they are back to work at their full capability the patient is allowed a PRN treatment plan through their WC claim. A PRN in medical terminology means an “as needed” basis treatment plan. Normally, the patient is given 12 PRN visits, and those visits usually end up being a once a month treatment plan.

 An employee should never be afraid to go to their employers and request aid   in trying to remedy a physical hindrance that was caused by an incident at work, for it is the employer’s responsibility to provide a safe and accommodating environment for their employees. It is required that all employers need to have workers’ compensation insurance. These benefits are provided, so employees won’t sue their employers. Also, it is illegal in most states for companies or employers not to hire someone because of a previous WC claim.
